Terms and Conditions

Please read the terms and conditions below and also review our Frequently Asked Questions page to fully understand our Punta Sur diving & snorkeling trips and PADI courses and certifications.

Guests should be in agreement with these terms and conditions before making a booking.

Refund Policy:

Punta Sur Divers refund policy attempts to accommodate its guests needs as much as possible in accordance with the following Terms & Conditions guidelines:

  • Cancellations made at least 30 days prior to your trip will merit a 100% refund of your deposit minus a 4.6% transaction fee.
  • If you cancel between 30 days and 1 week prior to your trip you will receive 50% of your deposit minus the 4.6% transaction fee.
  • If you cancel up to 24 hours prior to your trip you will receive a 25% refund. 
  • Cancellations done within the last 24 hours of your trip will merit no refund.

Refunds will only be processed via the original payment method and to the account from which the original payment was made. Processing fees are not refundable.

* Please note that refunds cannot be given for PADI materials that we purchased directly from PADI for courses.  These can be used at any PADI Dive Centre worldwide for up to 12 months from the date of the first login.

Cancellation by Punta Sur Divers

In the event that a cancellation has been made by Punta Sur Divers due to weather conditions( as explained below) or for any other reason.

Weather Conditions: If the weather on the day of your diving trip/open water dives of a course prevents us from having a safe and enjoyable experience you will be informed that the trip has either been cancelled or will need to be rescheduled or relocated.

Often the weather changes during the course of our trip. In the event of light rain without strong winds or big waves we will NOT cancel any dive trips, as it does not prevent us from having an enjoyable and safe experience.  

In order to ensure your safety, our dive schedule is subject to change without any prior notice due to weather conditions. Punta Sur Divers cannot be held responsible for adverse unforeseen weather conditions, involving rough seas and poor visibility.

We recommend a travel & cancellation insurance policy that covers for unforeseen circumstances.  We will fully support you with any travel insurance claims.

Payment and Booking Conditions

To secure your booking, we require either a 50 USD deposit or full payment in advance .  Bookings can not be held, guaranteed or confirmed until payment has been received. PADI course materials or codes can not be provided until we have received full payment for them and registration details for each student. If a deposit is paid, the remaining balance must be paid in full 48 hours prior to the course or paid when the materials are picked up (if paper manuals are being used) for the course by cash only.

All prices are advertised in US$ due to Mexico’s less stable financial market. All prices include taxes. Invoices are available upon request.  Payments can be made simply by using a credit or debit card. These payments will be processed by Stripe so Punta Sur will never store your credit card details directly. Alternatively payments can be made via bank transfers to our US or Mexican bank accounts.

If you would rather pay in cash, this can be done in any major currency using XE.com exchange rate on the day of payment or when quoted.  Please note that cash payment must be received in US dollars during the first da of diving.

Health and No Fly Time

All divers must be in good health to dive.  Students and Introduction Divers are required to complete a brief medical questionnaire.  Click here to view the medical form.  This form will guide you in order to find out if you need to visit a doctor prior to enrolling in a course.

You need to allow at least 18 hours to pass before flying after diving! So if flying the following day, make sure you contact us first.

Waiver of Liability

All divers must read, fill out, and sign a copy of PADI’s Liability Release and Assumption of Risk agreement and Punta Sur’s Liability Release before diving. Please review prior to booking here. Additional waivers and medical questionnaires may be required for those divers undergoing training, depending on the course requirements imposed by PADI.

Divers Certification and Equipment

Only certified divers may participate in scuba diving activities, unless they are enrolled in a scuba training program or Discover Dive and under the direct supervision of their certified Instructor or a Divemaster. Remember that when diving in the Cozumel Reefs National Park a certified guide from the Park MUST be leading the group. No divers are allowed by the National Park to dive by themselves or to perform certain activities (even with a guide) e.g. hunt. All scuba divers must accept full and complete responsible for themselves, their actions, and their equipment.

If a diver is unable to provide proof of certification, we reserve the right to not allow them to dive.

Divers may elect to use their own gear, or to use our equipment. Regardless, divers must inspect their gear prior to each and every dive, and they must be responsible for the proper functioning of that gear. All divers should understand the fact that every piece of equipment is capable of failure, and they must be prepared to respond accordingly.

Responsibility and Liability

Punta Sur Divers, its owners, employees, agents, and contractors are not responsible or liable for any injury, loss, accident, damage, delay, omission, irregularity or nonperformance occurring in connection with these arrangements. The client understands and accepts all risks associated with any and all activities, including both land based and water activities, air travel, car travel, swimming, snorkeling, scuba diving, and boating. Divers acting irresponsibly can have an adverse impact on their fellow divers and the diving community. As a result, we will not tolerate unsafe, illegal, or irresponsible behavior.

Lost or damaged gear

In case of lost or damaged gear through incorrect, irresponsible or inappropriate use through our customers, we will charge at cost price for damaged / lost items.

Please note you are responsible for your own personal belongings, Punta Sur Divers is not liable for any loss, damage or theft.

A note regarding ocean conditions & marine life encounters

Our trips & courses are based on interactions with wildlife in the ocean, as such no guarantees can be made that specified interactions will occur on any given day, nor what ocean or weather conditions will be like.
